These Site Terms of Use ("Terms") describe the rules for using this site (“Site”) and entry to the competition (“Competition”). These Terms constitute a legally binding agreement between you, as the person using this Site (“you” or “entrant”), and Variety SA, 68 Richmond Road, Keswick SA 5035 (“Variety SA”). Terms such as "we" or "our" refer to Variety SA.

1. Information contained on this Site, including how to enter, form part of these Terms. Entry into this Competition is deemed acceptance of the Terms by each entrant. Entry is via the online entry form only. By using this Site and submitting an entry, you agree to the most recent Terms. We may change these Terms at any time, and such changes will be posted on the Site. We encourage you to review these Terms each time you visit.
2. The Competition commences at 5.30pm on 26^th November 2013 (CST) and concludes on 31^st August 2014   at 4.00pm CST ("Promotional Period").
3. To enter, entrants must, during the Promotional Period, submit via this Site a story of no more than 100 words relating to their “Connection with Variety SA” and submit via this Site any associated photos or videos to support the story. The entry must be the original independent creation of the entrant and must be free from any claims, including copyright or trademark claims, by other parties.
4. Entrants must provide their full name and contact details as specified by the Site, including a valid email address. Entrants must complete the questionnaire in full in the manner required to qualify as an “Eligible Entrant”.
5. Eligible Entrants have unlimited entry into the Competition via the submission of unique entries, however each entrant is eligible to win one prize only.
6. Image or video must be submitted in accordance with instructions contained on the Site.
7. Entries must be received by Variety SA during the Promotional Period. Variety SA accepts no responsibility for late, lost or misdirected entries. Online entries will be deemed to be accepted at the time of receipt and not at the time of transmission.  
8. By entering, you agree not to sell or otherwise provide your submitted story and/or imagery to any media or other organization without the express permission of Variety SA.
9. Incomplete, incomprehensible and illegible entries will be deemed invalid and will be rejected. Variety SA reserves the right to disqualify any entry where it reasonably suspects that such materials are prohibited by these Terms, by any relevant law or are otherwise deemed inappropriate. This is at Variety SA’s discretion and no discussion will be entered into.
10. The Site incorporates a voting mechanism to allow for people to vote for published stories. Public voting will determine a Monthly “I am Variety” Champion, each of which will also become a finalist. A panel of representatives, appointed by Variety SA, will judge the finalists and determine an overall winning story based on merit. This winner will be named the “I am Variety” yearly Champion.
11. The successful entrant will be announced at the Show of Hearts Cocktail function on 12th September 2014 and on the Site in the following week. Variety SA’s decision is final and no correspondence will be entered into.
12. The winner will be notified by phone or email. If, for any reason whatsoever, Variety SA is unable to contact the winner within such time as Variety SA (in its absolute discretion) deems reasonable, Variety SA reserves the right to deem that person’s entry invalid, and to draw a new winner from the shortlisted entries.
13. The Site allows entrants the opportunity to post a photo on the Site or videos through YouTube, solely at our discretion.  Variety SA may remove or block submitted content from being posted on the Site, with or without cause, including without limitation quantity, size, technological difficulties or incompatibility, legalities, aesthetics, inappropriateness, errors, or anything else, at our sole discretion. 
14. You specifically agree not to post or transmit to the Site: inappropriate, unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material; or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law. We will fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity of anyone posting any such materials. 
15. While we will from time to time monitor or review submissions to the Site, we are under no obligation to do so and assume no responsibility or liability arising from the content of any such submission, nor for any error, violation of intellectual property rights including copyright or trade secret rights, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, invasion of privacy or publicity rights, or inaccuracy contained in any information submitted to the Site.
16. Entrants can only enter in their own name. Variety SA reserves the right to request the winner to produce (within the requested time) appropriate photo identification or other documentation (to Variety SA’s satisfaction, at its sole discretion) in order to confirm his or her identity, age, residential or email address, eligibility to enter and any information submitted by the winner in entering the promotion. If the documentation required by Variety SA is not received by Variety SA (or its nominated agent) or the winning entry has not been verified or validated to Variety SA’s satisfaction within the time requested, the winner's entry will become invalid. The prize will only be awarded following any winner validation and verification that Variety SA requires in its sole discretion.
17. Entrants consent to their names and images being used for public relations purposes relating to this Competition. Entrants consent to allow Variety SA access to and the rights to use submitted photographs and videos for promotional purposes. You agree that we have the right to display, not display, edit, or otherwise use any photos or video submitted for posting through the Site for any purpose consistent with the Competition.  You also specifically agree to the use of such images for further promotional purposes on behalf of Variety SA without any compensation, right of approval, or advance notice.  You specifically waive any claim associated with future promotional uses of your photo or video, including without limitation all rights of privacy or publicity.
18. All entries become and remain the property of Variety SA. Variety SA collects personal information about entrants to include entrants in the Competition and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the Competition. By participating in the Competition, each entrant also acknowledges that, unless the entrant specifies otherwise, Adelaide Shores may contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages, (SMS [Short Message Service], MMS [Multimedia Message Service], IM [Instant Messaging] and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. Variety SA may share information with any agency, authority, instrumentality, Minister or Officer of the State of South Australia when required. By entering the Competition, each entrant agrees that Variety SA may use entrants' personal information in this manner. Each entrant also agrees that Variety SA may publish or cause to be published the winner's name and locality in any media as required under the relevant lottery legislation (if applicable).
19. By entering the Competition, you confirm that all persons appearing in the photograph or video have consented to you submitting the imagery as part of this Competition, including to Variety SA’s right to use the imagery within this Competition as described in these Terms.
20. If for any reason Variety SA is unable to publish or otherwise use imagery submitted as part of this Competition, that entry may be excluded and the entrant may not be eligible for a prize.
21. Variety SA reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Terms, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition. Variety SA’s legal rights to recover damages or other compensation from such an offender are reserved.
22. If for any reason this Competition is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the control of Variety SA which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, Variety SA reserves the right in its sole discretion to cancel, terminate, modify or suspend the Competition, subject to any written directions given under applicable legislation.
23. At the end of each calendar month of the Promotional Period, the most popular entry at the end of that month, based on public voting, will be named as a Variety SA “I am Variety” Monthly Champion and will become a finalist in the running for the title of Variety SA “I Am Variety” Champion. Out of the nine Variety SA “I am Variety” Monthly Champions, one will be named the Variety SA “I Am Variety” Champion.
    Variety SA reserves the right to withdraw this Competition or any part of this Competition should their ability to fulfill due obligations be limited at any stage by any form of technical failure or the intervention of any outside act, agent or event.
24. Variety SA assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or technical failures or any other causes which affect the administration, security, fairness, integrity or proper conduct of this Competition. Variety SA reserves the right in its sole discretion to disqualify any individual who tampers with the entry process and take any action that may be available.
25. By ticking the optional box to indicate acceptance of the following statement, “I would like to receive news and information from Variety SA”, entrants acknowledge that they are agreeing to receive information in accordance with Clause 19. Entrants' personal information will be stored on a database by Variety SA.
